TERMS AND CONDITIONS
These Terms and Conditions and Internal Regulation (“Terms”) govern access to and use of the facilities, services, classes, memberships, class packages, events, and products offered by Frequency Pilates, Unipessoal Lda, NIF 518263266, with registered office at Rua de São Bento 156, Lisboa, Portugal, 1200-821, and studio located at Rua do Sol ao Rato 45A, Lisboa, Portugal, hereinafter referred to as “Frequency Pilates” or the “Studio”.

These Terms, together with the Studio Rules and Privacy Policy published online, constitute the full and complete agreement between the Studio and each client. They supersede any prior oral or written communications relating to Studio services. By registering an account, purchasing a service, booking a class, or entering the Studio, each client confirms that they have read, understood, and accepted these Terms.
If any provision is found to be invalid or unenforceable under applicable law, the remaining provisions shall remain fully valid and enforceable.
1. Client Status and Eligibility
A person becomes a client upon completing online registration and accepting these Terms. Acceptance as a client is subject to Studio approval and operational capacity. The Studio reserves the right to refuse, suspend, or permanently revoke access or membership where a client violates these Terms, disrupts operations, creates safety risk, or behaves in a manner considered harmful to the Studio environment or reputation. In such cases, no refund or credit restoration shall be due.
The minimum age to attend classes is sixteen (16) years old. Clients under eighteen may be required to provide written consent from a parent or legal guardian.
2. Access to the Studio
Access to the Studio and participation in classes is permitted only with a valid confirmed booking made through the official booking platform. Entry is allowed only during operating hours as published on the website or booking platform. Clients may not bring unregistered guests onto the training floor unless the guest is booked using an authorized guest pass or has prior written authorization from the Studio.
Animals are not permitted inside the Studio except for legally recognized assistance dogs. The Studio reserves the right to deny entry or remove any person for safety reasons or rule violations.
3. Class Capacity and Equipment Use
Class capacity is strictly limited. The maximum number of participants per class is twelve (12). Clients must use the machine assigned by the instructor and may not change machine or setup without instructor approval. Equipment may only be used during supervised sessions.
4. Bookings and Payment
All classes and services must be booked and paid in advance. Attendance without a confirmed booking is not permitted. If payment fails or is reversed, the Studio may cancel the booking without notice. Prices and applicable taxes are published and may be updated at any time.
5. Cancellation and No-Show Policy
All class bookings are subject to a strict cancellation window of twelve (12) hours before the scheduled class start time. Any cancellation made within twelve hours of class start is considered a late cancellation and results in automatic loss of the class credit. Failure to attend a booked class is considered a no-show and also results in automatic loss of the class credit.
This policy applies to all offerings without exception, including memberships, unlimited memberships, class packs, introductory offers, promotional packages, private sessions, complimentary credits, and guest passes.
Credits lost due to late cancellation or no-show are not restored, refunded, transferred, or replaced under any circumstances, including illness, travel delays, work conflicts, or booking errors.
6. Guest Passes and Guest Bookings
When a client books a class using a guest pass or guest credit, the booking remains the full responsibility of the client who made it. If the guest cancels within the late cancellation window or fails to attend, the guest credit is forfeited. Guest credits and guest passes are strictly non-refundable and non-restorable.
7. Instructor and Schedule Changes
The Studio reserves the right to change instructors, class formats, music style, or schedules at any time due to operational needs. An instructor change does not constitute grounds for cancellation without penalty and does not entitle the client to any refund or credit restoration.
8. Expiry of Services and Non-Extension Policy
All services and offerings sold by the Studio are subject to a defined expiry date communicated at the time of purchase. This includes memberships, class packs, introductory offers, promotional packages, and guest credits. Expiry dates are binding and automatically enforced by the booking system.
Unused classes and credits expire permanently after the expiry date. The Studio does not extend expiry dates for any reason, including illness, travel, scheduling conflicts, or non-use. Any exception is rare and entirely at the Studio’s sole discretion.
Unused credits do not roll over into future periods unless explicitly stated in writing at purchase.
9. Membership Rules
Memberships and class packages are personal and non-transferable and may not be shared. Membership terms, including any minimum commitment period and early termination conditions, are defined at the time of purchase. Membership does not guarantee availability in any specific class. Unlimited memberships may be subject to advance booking limits per day as defined by Studio policy.
10. Refund Policy
All purchases are final. The Studio does not provide refunds for unused classes, missed classes, late cancellations, no-shows, instructor changes, or schedule changes. Refunds are only issued where required by mandatory Portuguese consumer protection law.
11. Studio Conduct and Attendance Rules
Clients must arrive between five and ten minutes before class start time. Entry after class has started is not permitted and results in loss of the booking credit. Grip socks are mandatory for all classes. Appropriate athletic clothing must be worn. Mobile phones must remain off or silent and may not be used on the training floor. Clients must follow instructor instructions at all times and must clean equipment after use.
Disruptive, unsafe, or disrespectful behavior may result in immediate removal from class and suspension of Studio access.
12. Health and Fitness Declaration
Each client declares that they are physically fit to participate in exercise and do not suffer from any medical condition that makes participation unsafe. Participation is voluntary and at the client’s own risk. Clients must inform the Studio of any relevant health condition before class.
Pregnancy Participation Policy
Clients who are pregnant may participate in classes at their own discretion and comfort level, provided they have prior experience with reformer or machine-based training and feel physically comfortable continuing exercise. Frequency Pilates classes are strength-based and technically guided and are not prenatal or rehabilitation programs.
Clients who are pregnant and new to this type of machine-based exercise are strongly advised not to begin group classes for the first time during pregnancy. In such cases, the Studio recommends postponing participation or first obtaining written medical clearance and booking a private introductory session.
Pregnant clients must inform the instructor before class begins and are responsible for self-monitoring intensity and comfort level. The Studio reserves the right to modify or restrict participation where safety concerns are observed. Participation during pregnancy is voluntary and at the client’s own risk.
13. Personal Belongings
All personal belongings are brought into the Studio at the client’s own risk. The Studio accepts no responsibility for loss, theft, or damage.
14. Temporary Closures and Operational Changes
The Studio may temporarily close or adjust schedules due to maintenance, events, staff training, or circumstances beyond its control. No compensation or credit is owed in such cases.
15. Insurance
The Studio maintains legally required insurance coverage in accordance with Portuguese law. Insurance information is displayed on the premises.
16. Media Capture, Promotional Use and CCTV
Frequency Pilates may from time to time capture photographs and video recordings inside the Studio, including during classes, events, and training sessions, for promotional, educational, and commercial purposes, including but not limited to use on the Studio’s website, social media channels, digital platforms, press materials, and advertising.
By attending classes and entering the Studio premises, clients acknowledge that incidental inclusion in general class or atmosphere footage may occur. The Studio will make reasonable efforts to avoid close-up or individually focused promotional use without prior verbal confirmation; however, clients who do not wish to appear in any media content must inform the Studio in writing at info@frequencypilates.com or notify staff before class begins. Upon such request, reasonable efforts will be made to exclude that client from identifiable media use going forward.
Clients do not receive compensation for any authorized promotional use of images or recordings captured in the Studio environment.
The Studio reserves all rights, title, and interest in media content it produces.
17. Video Surveillance (Security Cameras)
For safety, security, and property protection purposes, Frequency Pilates operates video surveillance systems (CCTV) in selected areas of the Studio premises. Cameras are used exclusively for security monitoring, incident verification, and protection of clients, staff, and property.
CCTV recording is not used inside bathrooms or changing rooms.
Recorded images are stored for a limited retention period consistent with Portuguese data protection requirements and are accessible only to authorized personnel or authorities when legally required.
By entering the Studio premises, clients acknowledge and accept the existence of video surveillance for security purposes.
18. Liability Waiver
Physical exercise involves inherent risk of injury. By participating, clients acknowledge and accept these risks. Frequency Pilates is not liable for injuries arising from participation except where liability cannot legally be excluded under Portuguese law. This waiver remains in effect after termination of services.
19. Privacy and Data Protection
Personal data is processed in accordance with GDPR and Portuguese law. Clients may exercise their data rights by contacting info@frequencypilates.com. The Privacy Policy is available on the website.
20. Complaints and Governing Law
The Livro de Reclamações is available as required by law. These Terms are governed by Portuguese law and Portuguese courts have jurisdiction.
